
The Ministry of Communications (Department of Telecommunications) issued a notification on January 31, 2025, regarding the Telecommunications (Assignment of Spectrum through Auction) Rules, 2025. These rules, framed under the Telecommunications Act, 2023, aim to regulate the spectrum auction process, ensure transparent spectrum allocation, and define procedures for spectrum surrender and compliance.
Key Definitions & Terms
To ensure clarity in implementation, the rules define key terms, including:
- NIA (Notice Inviting Applications): A formal invitation for participation in spectrum auctions.
- SACFA (Standing Advisory Committee for Frequency Allocation): A committee overseeing technical coordination in spectrum management.
- SAL (Spectrum Assignment Letter): Issued to successful bidders after the auction process is completed.
The rules also clarify how the Telecommunications Act, 2023 will be interpreted in the context of spectrum assignment.
Spectrum Auction Process
- Identification of Frequency Bands: The Central Government will regularly determine which frequency bands will be available for auction.
- Reserve Price Determination: The TRAI will assist in setting a base price for auctions.
- Auction Execution: Auctions will be conducted by the Government or appointed agencies, with the highest bidder receiving the Spectrum Assignment Letter (SAL).
Eligibility & Auction Participation
- Eligibility Criteria: Participants must meet conditions outlined in the NIA (Notice Inviting Applications).
- Demand Letter Issuance: After the auction, successful bidders will receive a demand letter specifying spectrum charges and payment deadlines.
- Payment & Authorization:
- Bidders must pay spectrum charges and apply for authorization (if not already obtained).
- Failure to apply results in forfeiture of the earnest money deposit.
- If authorization is denied, the SAL is terminated, and charges are refunded after pro-rata deductions.
Spectrum Surrender Guidelines
- Eligibility for Surrender: A licensee holding spectrum for at least 10 years can surrender it, subject to conditions.
- Additional Spectrum Acquisition: If new spectrum is acquired after 10 years, the previously held spectrum can be surrendered after 2 years.
- Application Process: Licensees must apply at least 12 months before the surrender date and pay a ₹1,000 application fee.
- Approval & Post-Surrender Conditions:
- The Government will review applications and issue conditional approval based on dues.
- After surrender, the licensee is barred from participating in auctions for the same service area and spectrum band for 2 years.
- No refunds will be provided for surrendered spectrum.
Miscellaneous Provisions
- Compliance & Network Management: Spectrum holders must adhere to their SAL terms and avoid network interference.
- Spectrum Restructuring & Transfer: Holders may share, trade, or lease spectrum under the Telecommunications (Sharing, Trading, and Leasing of Spectrum) Rules, 2025.
- Licence Revocation: If an assignee’s telecom license is revoked, their spectrum assignment is also canceled, and the spectrum reverts to the Government.

Digital Implementation
The Government plans to digitally implement these rules through an online portal. This platform will facilitate application submissions, publication of forms, and issuance of approvals, ensuring a streamlined and efficient process.
